These Terms set out your rights and responsibilities when you access and use SPARX, and what you can expect from us. Please read them carefully.

Definitions used in these Terms

In these Terms:

  • Personal Information has the meaning given in the Privacy Act 2020 and generally refers to information about an identifiable individual.
  • Privacy Policy means our policy explaining how we collect, use, store, and manage your personal information.
  • SPARX means the SPARX website, desktop application, mobile applications, and related services.
  • We, our, and us mean the University of Auckland.
  • Terms means these Terms and Conditions.

When you use SPARX, you accept these Terms

When you register as a user and/or use SPARX, you acknowledge that:

  • You accept these Terms and agree to comply with them.
  • We may collect, use, and disclose your personal information in accordance with our Privacy Policy.
  • If you do not agree to these Terms or our Privacy Policy, you must not use SPARX.

Changes to these Terms

We may update these Terms from time to time by publishing a revised version on SPARX. Updated Terms may be made available through the SPARX website, desktop application, mobile applications, or other SPARX services.

By continuing to use SPARX after any changes are published, you agree to the updated Terms.

Purpose of SPARX

SPARX is a digital self-help and e-therapy tool designed to support mental wellbeing.

SPARX, including any screening tools, questionnaires, or assessments made available through the service, may help identify symptoms associated with low mood or depression, but does not provide a medical diagnosis.

Only a doctor or qualified mental health professional can diagnose and treat clinical depression or other mental health conditions.

If you are concerned about yourself or someone else, you should seek advice from a doctor or qualified mental health professional.

SPARX has been designed primarily for use in New Zealand.

If you need urgent help, call 111 or contact a qualified health professional immediately.

Conditions of use

You must:

  • Keep your password confidential and not share it with anyone else.
  • Use SPARX only for its intended purpose.
  • Provide accurate information when creating an account.
  • Comply with all applicable laws when using SPARX.

You must not:

  • Attempt to damage, disrupt, interfere with, or gain unauthorised access to SPARX or related systems.
  • Use SPARX in any unlawful, harmful, fraudulent, or misleading manner.
  • Share content that may interfere with the operation or security of SPARX.

Liability

SPARX is provided as a self-help and e-therapy tool only.

Information and content made available through SPARX are provided on an "as is" basis and for general information purposes only.

While we make reasonable efforts to maintain and improve SPARX, we do not guarantee that:

  • SPARX will meet every user's needs.
  • SPARX will always be available.
  • SPARX will be free from errors, interruptions, or defects.

We are not responsible for:

  • Any misuse of SPARX or associated links, resources, or services.
  • Any inability to access SPARX or related services.

Nothing in these Terms limits any rights you may have under the Consumer Guarantees Act 1993 or any other law that cannot be excluded.

Where we are legally permitted to limit our liability, our maximum liability to you will be NZ$100.

Ownership of SPARX

SPARX, including its content, software, design, graphics, trademarks, and other intellectual property, is owned by or licensed to the University of Auckland.

You may use SPARX only for your personal, non-commercial use and for its intended purpose.

You must not:

  • Copy, reproduce, distribute, modify, adapt, reverse engineer, or create derivative works from SPARX or its content.
  • Share SPARX content with others except where reasonably necessary to seek support from a healthcare professional.

SPARX is a registered trademark. Nothing in these Terms grants you any right to use any SPARX, University of Auckland, or related trademarks without prior written permission.

Access to SPARX

Your access to SPARX is temporary and not guaranteed.
We do not guarantee that:

  • SPARX will always be available.
  • Any particular version of SPARX will remain available.
  • Access will be uninterrupted or error-free.

We may suspend, restrict, or terminate your access to SPARX at any time if we reasonably believe you have breached these Terms or where necessary to protect SPARX, its users, or associated systems.

Third-Party Links and Services

SPARX may contain links to third-party websites, applications, or services.

These links are provided for your convenience and information only.

We do not control and are not responsible for the content, availability, or practices of third-party services and accept no responsibility for any loss or damage arising from their use.

General

These Terms are governed by the laws of New Zealand.

Any disputes relating to these Terms or your use of SPARX will be subject to the exclusive jurisdiction of the New Zealand courts.
